Terms of Service

These Terms of Service govern your use of Waymark Real Estate (“Waymark,” “the platform”). By creating an account or using our services, you agree to these terms.

Service Description

Waymark is a flat fee MLS listing service operated under Marelli Properties, a licensed Texas brokerage (TREC License 639078). We provide MLS listing submission, AI-powered transaction guidance through Aria, and defined broker oversight depending on your selected tier.

Pricing and Payment

Waymark charges a one-time flat fee: $699 (Launch) or $1,199 (Manage). Payment is required before your listing is submitted to the MLS. No percentage-based commission is charged at closing. Photo add-on services are priced separately.

Listing Term

Your MLS listing remains active until your home sells. There is no time limit and no renewal fees.

Aria is an AI-assisted tool that drafts, summarizes, and organizes transaction information. Aria does not provide legal advice, negotiate on your behalf, or make decisions for you. All AI-generated content involving licensed activity is reviewed by a licensed broker before execution. For legal questions, consult a licensed attorney.

Broker Oversight

On the Launch tier, broker involvement is limited to pre-listing review. On the Manage tier, broker oversight extends to offer review, contract checkpoint, repair negotiations, and appraisal gap decisions. The seller makes every final decision on both tiers.

Data Ownership

You own your personal information, listing data, and transaction records. Waymark owns the platform code, AI models, and brand marks. Anonymized aggregate data may be used for platform improvement.

Limitation of Liability

Waymark provides tools and support. Final decisions about pricing, offers, repairs, and closing terms are made by you. Waymark is not liable for outcomes of decisions you make using the platform.
